Safety Alert: Used Car Are Being Sold with Deadly Defects

Consumer safety advocates are asking why used vehicles can be sold even though they are subject to safety recalls. According to NBC Bay Area, consumer advocates are asking legislatures to pass laws that require used cars with unrepaired recalls to be inspected and fixed prior to sale. However, used car dealers say this type of legislation would make it much more difficult to sell or trade vehicles if all vehicles had to be repaired before selling them.

The National Highway Traffic Safety Administration, or NHTSA, enforces Federal motor vehicle safety laws. Currently, the National Highway Traffic Safety Administration does not prohibit used car dealers from selling used vehicles that have been recalled. However, the NHTSA does not permit new vehicles with open recalls to be sold. Safety advocates want federal law to contain a comparable prohibition on used vehicles.

State laws are mixed when it comes to selling used cars that are subject to recalls. For example, California law allows used car dealers to market used cars with active recalls. Many other states do not. Consumer advocates, including Consumers for Auto Reliability and Safety (CARS), have urged federal and state lawmakers to revise current laws to protect consumers from potentially dangerous cars.

..."The National Association of Auto Dealers stated that forcing dealers to make repairs to the vehicles prior to selling the vehicles will disrupt the flow of automobiles and might reduce the vehicle's worth by more than $5,000."

According to the news report, some of the used cars found for sale in the Bay Area have open recalls for such dangerous issues as:

  • doors that suddenly spring open, 
  • steering wheels that fall off, and
  • engines that suddenly stall without any reason.  

Consumers may protect themselves by searching a vehicle’s Vehicle Identification Number or VIN through the NHTSA website to see if their vehicle has been recalled so they can ask if the recall was repaired prior to purchase. The VIN check may also be used to check for open recalls on vehicles you own. The VIN recall check is a free service.
