Alec Baldwin and the production company involved with the movie “Rust” have been named as defendants in a wrongful death lawsuit. The lawsuit claims that Baldwin “recklessly shot and killed Halyna Hutchins on the set of the movie Rust.” The Plaintiffs, Halyna Hutchins’ estate, her 9-year-old son, and her husband filed the wrongful death lawsuit this past Tuesday. 

The complaint accuses Baldwin and other Defendants of failing to follow basic gun safety protocols and not performing industry-standard safety checks while they use real guns during the production of Rust, with deadly consequences.

The lawsuit also alleges that the defendants could have prevented her death and has a duty to avoid the incident by using safety protocols, but they cut corners on safety procedures to stay on schedule, and those responsible ignored several safety violation complaints. 

Back in October, Mr. Baldwin fatally shot Halyna and director Joel Souza while they were conducting a camera test. Halyna tragically passed away at the University of New Mexico Hospital. The director survived his gunshot wounds.

The wrongful death complaint states that the production was full of safety protocol breaches that led to the presence of live ammunition on the movie set, and the “aggressive cost-cutting” actions “endangered” the crew and cast. 

Halyna’s estate and surviving family members are demanding punitive damages, funeral and burial expenses, compensatory damages for the loss of companionship, love, care, comfort, protection, assistance, affection, guidance, society, training, and moral support.

According to the news report, the Santa Fe Sheriff’s Office has not charged anyone in the case at this time. The incident is currently under investigation by the Santa Fe Sheriff’s Office.
