Uber Manipulates a Personal Injury Claimant Into Giving Up Her Right to a Jury Trial

A news story from Patch.com reveals that an accident injury claimant filed an injury lawsuit against Uber, and Uber changed its Terms and Conditions “retroactively” in order to force claimants into arbitration. The plaintiff allegedly received an email sent by Uber. The email contained new Terms and Conditions. The plaintiff clicked a link accepting the updated terms and conditions without understanding that she accepted giving up her constitutional jury trial rights.
Uber’s attorneys are allegedly trying to have the court dismiss the victim’s case even though the victim unknowingly accepted the new Terms of Use designed to limit their legal rights to recover monetary compensation. Uber news Terms of Use also states that Uber riders “retroactively” waive their legal rights to a jury trial and that they agree to arbitration. The victim said that she was dismayed when she learned later that Uber was trying to use a “retroactive clause” in order to stop her from filing a lawsuit and demand a jury trial tin order to recover economic compensation for her Uber-related accident.
The young college student brought a personal injury claim against Uber when she was hit by another and she was severely injured and her Uber driver would not drop her off at a safe location next to a sidewalk. The plaintiff argues that when she asked the driver to drop her off at a specific spot, the Uber driver dropped her off at a very dangerous intersection, and this caused the victim to be struck by a car and severely injured. The victim reported that after they woke up following the accident, blood was running out of her mouth, and she lost several teeth. The victim also suffered many injuries and she has undergone reconstructive surgery and had dental implants placed into her mouth.
The victim stated that Uber drivers should pick up and drop off their riders at safe locations to prevent injuries and harm. She said that all rideshare companies must be held liable for their drivers’ negligent actions.
